What this is: CAPE Factory is software that prepares and structures data. It is not a law firm, it is not a customs broker, and it does not file anything on your behalf.
Nothing on this site is legal advice, and using it does not create an attorney-client relationship or a brokerage relationship. Classification, deadlines and interest figures are derived from published CBP guidance and statutory periods, then presented for your review. You and your client's licensed professionals decide what to file and when.
CAPE Factory generates declaration files, packets and reports. Submission through ACE or filing at the Court of International Trade is done by you, your client, or their counsel. We do not access ACE on your behalf and we do not hold credentials.
We do not guarantee any refund amount, timing, or eligibility. The IEEPA refund process is still moving: CBP phase rules have changed more than once, and the government's appeal on universal relief is unresolved. Output must be verified against current CBP guidance before it is relied upon.
The engine on this site is a demonstration. It classifies against published rules using the columns you supply and it does not have access to your ACE record. Flags such as collection-window and USMCA origin are prompts for human review, not determinations.
Do not attempt to disrupt the site, scrape it at volume, upload unlawful content, or use it to solicit importers with misleading claims about refunds. Given the volume of IEEPA refund fraud CBP has warned about, impersonation and phishing will be treated as a serious breach.
The site, its code and its content are owned by CAPE Factory. You may use output files freely for your own filings. You may not resell access to the service or republish the site as your own.
To the maximum extent permitted by law, CAPE Factory is not liable for indirect, incidental, or consequential damages, or for any loss arising from reliance on output that was not independently verified. Nothing here limits liability that cannot lawfully be limited.
The refund window is finite and the rules move. Features may change or be withdrawn as CBP guidance changes. We will keep the material disclaimers current.
These terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules.
